You acknowledge and agree that it is your responsibility to review this site and these Terms and Conditions from time to time and to familiarise yourself with any modifications. PREFACE. JERSEY TAXIAPP is a subsidiary of the Jersey Taxi Drivers Association (JTDA) both branches are run as non-profit organisations run on behalf of its members.
The Drivers App will only be made available to fully licensed PSV Drivers who are licensed and regulated by the Government of Jersey 'Driver and Vehicle Standards Department' (DVS). All PSV Drivers are self-employed and therefore recognised and acknowledged as the 'Driver' who provides the transportation within these terms and conditions.
JERSEY TAXIAPP is a registered trading name only.
ACCEPTANCE OF TERMS AND CONDITIONS. Downloading or otherwise accessing this App constitutes your acceptance of these Terms which take effect on the date from which you first start using the App. You are responsible for regularly reviewing the Terms and your continued use of the App after changes are posted constitutes your acceptance of these Terms as changed from time to time.
Every taxi journey taken is a separate and unique contract. No one contract has any bearing on another. Every journey constitutes a contract between you and the PSV Driver who has accepted your pre-booked taxi request via the automated App. We help connect passengers with taxis and taxis with passengers only.
The service of the taxi journey is the service provided by the Driver. We do not charge for the service of connecting you with a Driver. We do not accept liability for any losses you incur as a result of using a taxi connected to our service.
Every PSV taxi Driver holds by law 'Public Liability Vehicle Insurance' it is also a requirement that the Driver shows a valid insurance certificate to the Government of Jersey DVS Department during the vehicles annual inspection.
1. DEFINITIONS. In the Conditions (as defined below) the following Terms shall have the following meanings unless expressly stated otherwise:
1.1. “App” means any mobile application software provided by the JTDA, including the JERSEY TAXIAPP, and any other App as may be notified from time to time and any updates or upgrades to such software.
1.2. "TaxiCaller" means the taxi booking and dispatch App developer and Data Processor who maintains the App and in compliance to processing personal data under our Service Agreement in order to ensure that the personal data is processed in accordance with the provisions in the EU General Data Protection Regulation (GDPR) and any subsequent legislation replacing or supplementing the above.

1.3. “Charge” means any charge to download an App and/or the use of any or all Services available via the App. The JERSEY TAXIAPP is free for all customers to download and use after registering.

1.4. “Conditions” means these Terms and Conditions including any variations thereto.
1.5. “Contract” means the agreement between the Customer and JERSEY TAXIAPP for the use of the App, which agreement is governed by these Conditions and which takes effect on the date on which the Customer first uses the App.
1.6. “Customer” means any person downloading and/or using the Customer App.
1.7. “Driver” means any holder of a Public Service Vehicle License (PSV) who uses the Driver Companion App in order to offer Customer transportation via the App.
1.8. “Equipment” means the Customer or Driver mobile device, computer system, set-top box, console, web-enabled television or any other equipment used to download and/or use this App.
1.9. “First Uses the App” means the earlier of: (a) the date on which the Customer downloads the App to their Equipment; or (b) the date on which the Customer first uses the App.
1.10. “JERSEY TAXIAPP” is the registered name and a subsidiary of the JTDA . It is also the name of the Customer App referred to in these Terms and Conditions as the “App”.
1.11. “Material” means any information, file, data, or any other material located at or made available through the App.
1.12. “Online” means accessible over the World Wide Web or such other site as may be notified from time to time.
1.13. “Registration Data” means the information required by the App to enable the Customer to have full access to that App and includes personal data and access codes.
1.14. “Service” means any Material and/or any other service provided by the JERSEY TAXIAPP that is accessible by the Customer via the App.
1.15. “Website” means the information located at URL http://www.jerseytaxidriversassociation.co/ or such other website as may be notified from time to time. 1.16. "JTDA Social Media". means the information located at both.

2. REGISTRATION. In order to use the App the Customer will be required to register.
2.1.1. by registering, the Customer agrees to provide true, accurate, current and complete information as prompted by the App; and
2.1.2. maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
2.2. If the Customer provides any information that is untrue, inaccurate, not current or incomplete, or the JERSEY TAXIAPP is of the view that such information is untrue, inaccurate, not current or incomplete, the JERSEY TAXIAPP has the right, at its sole discretion, to suspend or terminate the Contract and to refuse any and all current or future use of the App by the Customer.
3. USER CONDUCT. The Customer shall not:
3.1.1. cause or allow another to cause Material to be copied, reproduced, republished, posted, broadcast or transmitted in any way except for the Customer’s own private, non-commercial or internal business use;
3.1.2. adapt, alter or create a derivative work from any of the Material or cause the same to be so dealt with or use or cause it to be used for any other purpose other than for the
personal non-commercial use of the Customer;
3.1.3. use any of the Material to check, confirm, amend or update the Customer’s databases, records, directories, Customer lists, mailing or prospecting lists or somebody else’s databases, records, directories, Customer lists, mailing or prospecting lists;
3.1.4. attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; and
3.1.5. modify, adapt, translate or reverse engineer any part of the App.
3.2. The Customer shall use the App only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the App by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content.
4. SUSPENSION / MODIFICATION OF THE APP. JERSEY TAXIAPP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently the App with or without notice. JERSEY TAXIAPP shall not be liable to the Customer or to any third party for any modification, suspension or discontinuance.
4.1. JERSEY TAXIAPP reserves the right at any time to edit or remove any Material, in whole or in part, for any reason whatsoever at our sole discretion.
4.2. JERSEY TAXIAPP reserves the right to suspend a Customer for, rudeness, abuse or violence, threatened or actual, towards the Driver, or other JERSEY TAXIAPP members.
4.3. Conducting themself in a manner likely to bring the JERSEY TAXIAPP into disrepute.
4.4. Conduct liable to prejudice the JERSEY TAXIAPP.
5. RULES OF HIRE. It is illegal for a child under the age of three to travel in a taxi without a proper, designated child seat. All taxis must carry a booster seat which is for a child up to 35 KG.
5.1. The consumption of food or drink is prohibited in Taxis, takeaway food should be kept wrapped up and some Drivers may ask you to put the food into the luggage compartment as takeaways can leave an odour in the vehicle and there is always a risk of accidents.
5.2. The Driver has the right to refuse or continue on a journey if a passenger or passengers are too intoxicated, if their behaviour becomes unruly or aggressive or if they use foul and abusive language.
5.3 The Driver has the right to charge a minimum fee of £150.00 for soiling the taxi or for causing any damage. If feeling unwell it is the Customers responsibility to ask the Driver to stop the vehicle as soon as possible.
5.4. All Taxis are licensed to carry a maximum amount of passengers. Most carry 4 passengers and some can carry up to 8, which can be requested via the App if available. Drivers cannot take more passengers than their licence permits as this would be breaking Jersey Motor Traffic Law and would also invalidate the Drivers vehicle insurance.
5.5. The Driver can refuse to take over sized cases or luggage, if one piece of luggage weighs more than 30 KG or there are too many cases to fit safely in the vehicle's trunk.
5.6. The Driver can refuse a passenger's request to go down a dirt track or improper surface if the Driver thinks that by doing so the vehicle may get stuck or damaged.
5.7. JERSEY TAXIAPP does not offer business or personal accounts at this present time. Payments for all pre-booked fares are to be made direct to the Driver by either using cash or by debit or credit card.
5.8. Invoice or receipt of the taxi fare can only be optained directly from the taxi driver, at the time of the service. Our role is solely to facilitate customer bookings for self-employed taxi drivers. We do not handle accounts or customer payments.
5.9. Refusing to pay or deliberately taking action to avoid paying the fare after reaching your destination will mean automatic suspension from using the App. The Driver also reserves the right to pursue payment by informing the authorities or by making a legal claim recoverall costs incurred.
5.10. JERSEY TAXIAPP reserves the right to permanently suspend any Customer without warning from using the App if its considered that they are deliberately cancelling pre-booked fares in order to abuse the service. This action will also be taken if the Customer repeatedly fails to turn up at the agreed time or location.
5.11. All pre-booked jobs are logged by TaxiCaller International Limited along with the Customer and Drivers details and a booking reference number.
5.12. JERSEY TAXIAPP will be divided into many different areas known as Zones.
At certain peak times such as late Friday and Saturday nights it may be necessary for a zone to be switched off, as for example the Weighbridge Taxi Rank could be extremely busy during those times.

6. USERNAME, PASSWORD AND SECURITY. The Customer is responsible for maintaining the confidentiality of any username and password entered as Registration Data. The Customer is fully responsible for all activities that occur under their username and will immediately notify the JERSEY TAXIAPP of any unauthorised use of their username or any other breach of security.
7. PRIVACY POLICY. Registration Data and other information collected about the Customer will be processed under the The Data Protection (Jersey) Law 2018 . and/or other such laws or regulations as may be applicable. TaxiCaller maintains the App along with keeping Customers registered details on their database in accordance with the provisions in the EU General Data Protection Regulation (GDPR)
7.1. JERSEY TAXIAPP will not without the Customer’s written consent disclose information provided to it by the Customer for the purposes of the Contract to anyone other than (i) members of the JERSEY TAXIAPP Group or (ii) subject to the relevant Data Protection legislation, third party subcontractors or agents engaged by the JERSEY TAXIAPP, such disclosure being made in either case in order for it to be able to provide the Customer with a Service.
7.2. JERSEY TAXIAPP is registered with the JOIC 'Registered NO: 62893 ' and adheres to strict data protection policies in accordance with the The Data Protection (Jersey) Law 2018 as applicable.
7.3. JERSEY TAXIAPP reserves the right to disclose the Customer’s name, address, telephone and/or facsimile numbers and/or email addresses to any judicial, law enforcement, regulatory or Governmental body or agency where required by applicable law or by the Order of a court or other body of competent jurisdiction to do so.
7.4. By accepting these conditions, the Customer agrees to allow JERSEY TAXIAPP, in accordance with the relevant Data Protection Legislation, to arrange for and/or to send to the Customer advertising and promotional material relating to other JERSEY TAXIAPP services or promotional material relating to other JERSEY TAXIAPP services or products or third-party products or services as chosen by JERSEY TAXIAPP.
7.5. The Customer may withdraw such permission as given above in clause 7.4 by notifying the JTDA online or by email to [email protected].
8. LINKS JERSEY TAXIAPP may include links to other websites or resources except for content that JERSEY TAXIAPP itself publishes online. JERSEY TAXIAPP has no control over such websites and resources, is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials present or available from such websites or resources.
9. LIMITATIONS AND EXCLUSIONS. In no event shall the JERSEY TAXIAPP, nor its committee, members, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9.1. JERSEY TAXIAPP shall not be responsible for the loss or damage during any Driver transportation of the following:- money or securities (whether cash, cheques, bankers drafts, bonds, share certificates or in any other form), antiques, precious metals, furs, or jewellery (in any form whatsoever) of whatever amount or value. Any goods or property (of whatsoever nature) any goods or property of a hazardous, dangerous, inflammable, explosive or noxious nature, or are illegal to possess under existing Jersey Law, and/or any goods or property (of whatsoever nature) which may deteriorate in transit.
9.2. JERSEY TAXIAPP shall not in any event be liable directly or indirectly for consequential loss (whether for loss or profit or otherwise) and/or loss, damage and/or breakage to china,glass, ceramics or other breakables whether arising from the acts, omissions or negligence of the Driver and/or their employees and/or agents or arising otherwise howsoever.
9.3. JERSEY TAXIAPP shall not be liable for any loss and/or damage arising directly or indirectly from:- breakdown, accident, adverse weather conditions or any act or omission on the part of the Driver.
9.4. Any clause, act or circumstance beyond the control of the JERSEY TAXIAPP (including, without limitation, any strike, (official or not), lock-out or other form of industrial action or labour dispute, Governmental regulations, legal restrictions, embargoes, fire, flood, Act of God, any consequence of riot, war, invasion, act of foreign enemy, hostilities (whether war be declared or not) civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition or destruction of or damage to property by or upon the order of or in the name of any Government or public local authority).
9.5. JERSEY TAXIAPP shall not be liable for inadequate or inappropriate packaging of goods, or incorrect or inadequate labelling or instructions received from the Customer and/or the Driver being prevented or hindered from delivering the Customer, goods or property to the required destination.
10. DISCLAIMER . Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
11. TERMINATION. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
12. GOVERNING LAW. These Terms and Conditions shall be governed and construed in accordance with the laws of Jersey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

5.9. Refusing to pay or deliberately taking action to avoid paying the fare after reaching your destination will mean automatic suspension from using the App. The Driver also reserves the right to pursue payment by informing the authorities or by making a legal claim recoverall costs incurred.
5.10. JERSEY TAXIAPP reserves the right to permanently suspend any Customer without warning from using the App if its considered that they are deliberately cancelling pre-booked fares in order to abuse the service. This action will also be taken if the Customer repeatedly fails to turn up at the agreed time or location.
5.11. All pre-booked jobs are logged by TaxiCaller International Limited along with the Customer and Drivers details and a booking reference number.
5.12. JERSEY TAXIAPP will be divided into many different areas known as Zones.
At certain peak times such as late Friday and Saturday nights it may be necessary for a zone to be switched off, as for example the Weighbridge Taxi Rank could be extremely busy during those times.

6. USERNAME, PASSWORD AND SECURITY. The Customer is responsible for maintaining the confidentiality of any username and password entered as Registration Data. The Customer is fully responsible for all activities that occur under their username and will immediately notify the JERSEY TAXIAPP of any unauthorised use of their username or any other breach of security.
7. PRIVACY POLICY. Registration Data and other information collected about the Customer will be processed under the The Data Protection (Jersey) Law 2018 . and/or other such laws or regulations as may be applicable. TaxiCaller maintains the App along with keeping Customers registered details on their database in accordance with the provisions in the EU General Data Protection Regulation (GDPR)
7.1. JERSEY TAXIAPP will not without the Customer’s written consent disclose information provided to it by the Customer for the purposes of the Contract to anyone other than (i) members of the JERSEY TAXIAPP Group or (ii) subject to the relevant Data Protection legislation, third party subcontractors or agents engaged by the JERSEY TAXIAPP, such disclosure being made in either case in order for it to be able to provide the Customer with a Service.
7.2. JERSEY TAXIAPP is registered with the JOIC 'Registered NO: 62893 ' and adheres to strict data protection policies in accordance with the The Data Protection (Jersey) Law 2018 as applicable.
7.3. JERSEY TAXIAPP reserves the right to disclose the Customer’s name, address, telephone and/or facsimile numbers and/or email addresses to any judicial, law enforcement, regulatory or Governmental body or agency where required by applicable law or by the Order of a court or other body of competent jurisdiction to do so.
7.4. By accepting these conditions, the Customer agrees to allow JERSEY TAXIAPP, in accordance with the relevant Data Protection Legislation, to arrange for and/or to send to the Customer advertising and promotional material relating to other JERSEY TAXIAPP services or promotional material relating to other JERSEY TAXIAPP services or products or third-party products or services as chosen by JERSEY TAXIAPP.
7.5. The Customer may withdraw such permission as given above in clause 7.4 by notifying the JTDA online or by email to [email protected].
8. LINKS JERSEY TAXIAPP may include links to other websites or resources except for content that JERSEY TAXIAPP itself publishes online. JERSEY TAXIAPP has no control over such websites and resources, is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials present or available from such websites or resources.
9. LIMITATIONS AND EXCLUSIONS. In no event shall the JERSEY TAXIAPP, nor its committee, members, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9.1. JERSEY TAXIAPP shall not be responsible for the loss or damage during any Driver transportation of the following:- money or securities (whether cash, cheques, bankers drafts, bonds, share certificates or in any other form), antiques, precious metals, furs, or jewellery (in any form whatsoever) of whatever amount or value. Any goods or property (of whatsoever nature) any goods or property of a hazardous, dangerous, inflammable, explosive or noxious nature, or are illegal to possess under existing Jersey Law, and/or any goods or property (of whatsoever nature) which may deteriorate in transit.
9.2. JERSEY TAXIAPP shall not in any event be liable directly or indirectly for consequential loss (whether for loss or profit or otherwise) and/or loss, damage and/or breakage to china,glass, ceramics or other breakables whether arising from the acts, omissions or negligence of the Driver and/or their employees and/or agents or arising otherwise howsoever.
9.3. JERSEY TAXIAPP shall not be liable for any loss and/or damage arising directly or indirectly from:- breakdown, accident, adverse weather conditions or any act or omission on the part of the Driver.
9.4. Any clause, act or circumstance beyond the control of the JERSEY TAXIAPP (including, without limitation, any strike, (official or not), lock-out or other form of industrial action or labour dispute, Governmental regulations, legal restrictions, embargoes, fire, flood, Act of God, any consequence of riot, war, invasion, act of foreign enemy, hostilities (whether war be declared or not) civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition or destruction of or damage to property by or upon the order of or in the name of any Government or public local authority).
9.5. JERSEY TAXIAPP shall not be liable for inadequate or inappropriate packaging of goods, or incorrect or inadequate labelling or instructions received from the Customer and/or the Driver being prevented or hindered from delivering the Customer, goods or property to the required destination.
10. DISCLAIMER . Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
11. TERMINATION. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
12. GOVERNING LAW. These Terms and Conditions shall be governed and construed in accordance with the laws of Jersey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
